Luminate Co Terms of Service

1 About these terms
These Terms of Service apply to the Luminate Co online store at luminateco.ca and purchases of retail products from Luminate Co Inc. (Luminate Co, we, us or our). Please read them together with the product information, checkout details, Shipping and Returns Policy, Refund Policy and Privacy Policy linked below before ordering. Keep a copy for your records.
These terms do not govern clinic appointments, professional healthcare services or clinical consent. Arrangements for those services are handled separately.
Nothing in these terms or our linked policies excludes or limits consumer rights, warranties or remedies that cannot lawfully be excluded or limited. If a provision conflicts with those rights, the applicable law prevails.
2 Ordering and using your account
To place an order, you must be legally able to enter into a binding contract. If you are under the age of majority where you live, ask a parent or legal guardian to place the order for you.
Provide accurate contact, billing and delivery information and review your order before submitting it. Use only a payment method you are authorized to use. Keep account sign-in details secure and contact us promptly if you suspect unauthorized use.
Orders are subject to product availability and reasonable payment and fraud checks. If we cannot supply an item, or identify a material pricing or product-description error affecting your order, we will contact you. We will not substitute a product or charge a higher price without your agreement. If an affected order or item is cancelled, we will refund amounts paid for it, including applicable taxes and delivery charges as required by law.
3 Prices and promotions
Prices are in Canadian dollars unless expressly stated otherwise. Applicable taxes and shipping or delivery charges are shown at checkout before you pay. The payment methods available for your order appear at checkout.
Prices and availability may change for future purchases. Promotions are subject to the eligibility, dates and exclusions stated with the offer. Changes to prices or promotions do not retroactively change an existing order.
4 Shipping and delivery
We currently ship within Canada. Available delivery options, charges and restrictions are described in our Shipping and Returns Policy and at checkout. Free-shipping eligibility is subject to that policy’s order-value, weight and remote-address conditions.
Processing and transit estimates are estimates unless we expressly agree to a delivery date. This does not limit any legal right to cancel or obtain a remedy for late or missing delivery. Please use an accurate, safe delivery address and contact us if an order does not arrive as expected.
5 Cancellations and returns
Our Shipping and Returns Policy and Refund Policy set out cancellation, return and exchange procedures, including the 14-day return window, product-condition requirements, final-sale categories and return-shipping responsibilities. For shipped orders, the return window runs from delivery. Cancellations before shipment receive a full refund under the published policy.
Please contact info@luminateco.ca promptly about damaged, incorrect or missing items. The policy requests notice within 24 hours to help with courier claims. That request, final-sale labels and other store-policy limits do not remove remedies available under applicable law for defective, misdescribed or undelivered goods.
6 Product information
We aim to describe products accurately. Packaging and appearance may vary, and manufacturers may update ingredients or instructions. Read the current product label, warnings, storage instructions and allergen information before use. Contact us if the item received differs materially from what you ordered.
Store articles and product information are general information, not individualized medical advice. Purchasing a product does not create a practitioner–patient relationship. Consult an appropriate healthcare professional about suitability where needed. Nothing in this section reduces our responsibility for accurate product information or your legal rights.
7 Respectful and lawful use
Do not use the website for fraud, unlawful activity, unauthorized access, interference with its operation or infringement of another person’s rights. We may restrict access where reasonably necessary to address those activities. Any restriction remains subject to our obligations concerning existing orders and refunds.
Website text, photographs, branding and other content belong to Luminate Co or their respective owners. You may use the website for personal shopping and retain information about your purchases. Other copying or commercial use requires the relevant owner’s permission, except where permitted by law.
8 Privacy and communications
Our Privacy Policy explains how personal information is handled in connection with the online store. We may contact you about your order, delivery, account or a product-safety issue using the contact details you provide, as permitted by law.
Accepting these terms does not itself give express consent to marketing emails or text messages. Marketing communications remain subject to applicable consent and unsubscribe requirements.
The store uses Shopify technology. Links to third-party websites or services may have their own terms and privacy practices. This does not remove our responsibilities as the seller.
9 Problems and applicable law
If something goes wrong, contact us using the details below so we can try to resolve it. You retain all rights and remedies available under applicable law, including any rights concerning product quality, cancellation, refunds and disputes. These terms do not require arbitration or waive a right to bring or participate in a court proceeding.
For customers outside Quebec, these terms are governed by Nova Scotia law and applicable Canadian federal law, subject to any mandatory protections and court rights in the customer’s province or territory. For Quebec consumers, Quebec law and applicable Canadian federal law apply. No provision requires you to give up a legally protected local forum.
10 Changes to these terms
We may update these terms for future use and purchases by posting a revised version with its effective date. The version applicable when an order is placed continues to apply to that order unless a change is required by law or we agree otherwise with you. If a provision is unenforceable, the remaining provisions continue only to the extent permitted by law.
